St. Louis CIN Acceptable Use Policy

1. Revocable privilege. Access and use of the ST. LOUIS CIN system is a privilege which may be revoked by ST. LOUIS CIN at any time, with or without prior notice to the User, upon reasonable suspicion that the User has committed, or has knowingly permitted any other person to commit, unauthorized or improper use of the ST. LOUIS CIN system. Unauthorized or improper use of the ST. LOUIS CIN system includes, but is not limited to: use of the system for any purpose or activity that is prohibited by federal, state, or local laws, rules, or regulations; knowingly permitting an unauthorized person to access the ST. LOUIS CIN system; and failing to abide by all rules and regulations now in effect or hereafter promulgated by ST. LOUIS CIN in the User's access and use of the ST. LOUIS CIN system. The User specifically agrees not to permit any other person to use User's ST. LOUIS CIN identification number or password to access the ST. LOUIS CIN system. ST. LOUIS CIN reserves the right to terminate an account that has been inactive for at least six months.

2. Reservation of Rights. ST. LOUIS CIN expressly reserves the right to access and review any and all material stored in ST. LOUIS CIN files and programs, and to edit or delete material which is found to be pornographic or obscene within the meaning of Chapter 573 of the Revised Statutes of Missouri or otherwise unlawful material prohibited by federal, state, or local laws, rules or regulation. ST. LOUIS CIN agrees that it shall not disclose or otherwise reveal directly or indirectly, to any third party, all material stored in ST. LOUIS CIN files and programs unless in violation of any federal, state, or local laws, rules or regulation. ST. LOUIS CIN also reserves the right to assess the overall security of the system.

3. ST. LOUIS CIN's Disclaimer. Material and information contained in or accessible through the ST. LOUIS CIN system is intended only for general, nonspecific, informational purposes, uses, and applications. ST. LOUIS CIN does not expressly or impliedly warrant the quality, accuracy, veracity, completeness, or authenticity of any materials or information contained in or accessible through the ST. LOUIS CIN system, nor does ST. LOUIS CIN represent that the ST. LOUIS CIN system is designed or intended for any specific purpose, use, or application. ST. LOUIS CIN shall not be liable for any direct or indirect, incidental, or consequential damages, including lost data, lost information, or lost profits, sustained or incurred by any person in connection with the use, non-use, or operation of the ST. LOUIS CIN system.

   The ST. LOUIS CIN and its representatives will in certain instances assist members in setting up their computers to access the ST. LOUIS CIN computer system. This assistance is given at the discretion of ST. LOUIS CIN. ST. LOUIS CIN does not offer any guarantee as to the availability or timeliness of any such assistance. ST. LOUIS CIN members release and hold harmless the ST. LOUIS CIN and all members for any damages that may result from assistance provided by the ST. LOUIS CIN or any of its representatives

   ST. LOUIS CIN will not assume any responsibility for registering software or obtaining releases for any and all copyrighted materials obtained through the ST. LOUIS CIN by its users.

4. Defense and Indemnification. The User agrees to abide by all rules and regulations now in effect or hereafter promulgated by ST. LOUIS CIN in the User's access and use of the ST. LOUIS CIN system. The User agrees to defend, indemnify, and hold harmless ST. LOUIS CIN, its members, its governing board, and its employees, agents, and officers for any and all manner of suits, claims, causes of action, and judgments arising out the unauthorized or improper use of the ST. LOUIS CIN system by the User or by any person improperly using the ST. LOUIS CIN system with the knowledge and consent of the User.

5. User's Disclaimer. The User understands and agrees that no professional relationship such as attorney-client, doctor-patient, counselor-patient, accountant-client, or similar relationship is or can be established through the access and use of the ST. LOUIS CIN system by the User; that User will not seek to establish or claim there has been established, any such professional relationship; and that those persons directly or indirectly providing advice or information to Users through the ST. LOUIS CIN system are entitled to rely on User's disclaimer as set forth in this paragraph as an inducement to provide materials and information to the ST. LOUIS CIN system.

6. Content Responsibilities. Commercial activities are prohibited. Use of the ST. LOUIS CIN system for purposes of commercial advertising and other for profit use is expressly prohibited; provided, that individuals, institutions, corporations, foundations, agencies, and other identifiable entities whether private or public, for-profit or not-for-profit, may be given appropriate recognition as contributing to the funding, content, preparation, presentation, or distribution of materials and information contained in the ST. LOUIS CIN system. ST. LOUIS CIN expressly reserves the right to access and review any and all material stored in files and programs which are generally accessible to ST. LOUIS CIN users, and to edit or delete material which is found to constitute commercial advertising.

   Equal community access. The ST. LOUIS CIN provides access for the posting of ST. LOUIS CIN community content. A User with this type of account understands and agrees to ensure equal opportunity to relevant parties for inclusion of content pertaining to the specific community of the ST. LOUIS CIN.
